Powerhouse Dynamics Privacy Policy
Powerhouse Dynamics (“us”, “we”, or “our”) operates www.sitesage.net, www.powerhousedynamics.com, and the SiteSage / Open Kitchen mobile app on multiple platforms (jointly referred to as the “Site”). This Privacy Policy is intended to inform you of our policies and practices regarding our collection, use, and disclosure of the information you submit to us, and that we collect from you through the Site, as well as other channels.
This page informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of the Site. We use your Personal Information only as specified in this Privacy Policy, or as required by law. If you do not agree with our policies and practices, your choice is not to use our Site. This Privacy Policy may change from time to time, so please check this Privacy Policy periodically for updates.
Information We Collect
We collect different types of information about you, including information that can identify, relate to, describe, be associated with, or be reasonably capable of being associated with a
consumer or household (“Personal Information”); as well as information that is about you but individually does not personally identify you (“Other Information”) and information that we combine with our other users. While using our Site, we may collect Personal Information about you in a number of ways.
Information You Provide: There may be times (such as when you create an online account, purchase a product, subscribe to a service, etc.) when we ask you to provide certain contact information about yourself. This information typically includes your name, home address, other physical address, e-mail address, telephone number, credit or debit card number, account number, and information concerning your purchase or use of Powerhouse Dynamics products or services such as, kind of product or service purchased, product model number, product serial number. When you contact us by telephone, we will collect the information you provide over the telephone. When you contact us by SMS, or opt in to communication by SMS, we will collect your phone number, consent to send SMS messages, basic contact information, and messaging history. We will also collect information you provide in product registration card submissions.
Information Collected Automatically: We automatically collect detail about visits to our Site, specifically traffic data, location data, logs, and other communication data and the resources that you access and use on the Site. We may also collect information about your computer and internet connection, specifically your IP address, operating system, and browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics. The information we automatically collect is used for various reasons, such as to determine our usage patterns; store information about your preferences, allowing us to customize our Site according to your individual interests; and recognize you when you return to our Site. We go into more detail regarding the purposes for which we use Personal Information later in this Privacy Policy. In addition, we may use third party services such as Google Analytics that collect, monitor, and analyze these data. Data we collect automatically, which may not be personal information, is treated as personal information when it is attached to other personal information.
Information from Third Parties: We may receive information from our affiliates and business partners that you provide to them. This includes information you provide to distributors or dealers of Powerhouse Dynamics products and services, information you provide to Powerhouse Dynamics divisions, information you provide in connection with warranty service claims and in response to surveys.
Use of Personal Information
We use your Personal Information to provide you with the services you request, as well as contact you with newsletters, marketing or promotional materials and other information designed to ensure your productive use of the Site. In addition, we use Personal Information, and Other Information coupled with Personal Information for the following purposes:
- To respond to your inquiries and fulfill your requests, including to contact you if necessary;
- To send you the SMS messages you’ve opted in to receive. You can opt out of receiving SMS messages at any time by replying STOP to any message we send you;
- To process and fulfill your order, for example by confirming your order and your billing and shipping information, processing your payments, delivering your products and communicating with you regarding your order;
- To send to you important information regarding our Site, changes to our terms, conditions and policies and other administrative information;
- To send to you information by email, postal mail, telephone, SMS, and other means about our products, services, contests, sweepstakes and other promotions;
- To help us improve the customer experience, including by learning more about your preferences to help personalize your experience with us;
- To analyze trends and statistics in connection with our businesses and Internet properties, including to measure the success of marketing campaigns and to compile statistics about usage and response rates;
- To protect the security or integrity of our businesses and Internet properties; and
- As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our Affiliates; (f) to protect our rights, privacy, safety or property, or that of you, our Affiliates or others; and (g) to allow us to pursue available remedies or to limit the damages that we may sustain.
Sharing of Personal Information
Powerhouse Dynamics may share Personal Information, for the purposes specified in this Privacy Policy, with its affiliates, or divisions, and with their officers, directors, employees, accountants, attorneys, and agents; with distributors or dealers of Powerhouse Dynamics products and services; with Powerhouse Dynamics’s marketing partners; with third-parties to comply with applicable laws or legal processes (including but not limited to subpoenas, interrogatories, requests for documents, and regulatory data requests); with third-parties to protect the rights or property of Powerhouse Dynamics; and with law enforcement, regulatory, and government authorities.
Opting Out Of Marketing and Updating Your Information
We want to communicate with you only if you want to hear from us. If you prefer not to receive direct marketing from us or from our affiliates, or if you prefer that we do not share your information with our marketing partners, please contact us as described below.
Every email you will receive from us will contain clear information on how to unsubscribe from future communications. If you sign up for communications from us but then wish to unsubscribe, follow the unsubscribe instructions in the email you receive from us to be removed from future marketing emails. We may also send you communications via postal mail. If you are receiving postal mail communications from us and wish to no longer receive them, please contact us as described below to ask us to remove you from our postal mailing list.
If you would like to update or correct your email address, mailing address or other contact information with us please contact us the same way. Please note that it may take up to 30 days to remove your contact information from our marketing communications lists, so you may receive correspondence from us for a short time after you make a request.
Cookies
SiteSage use “cookies” to track your preferences and activities in the SiteSage.net web application. Cookies are small data files transferred to your computer’s hard drive by a website. They keep a record of your preferences making subsequent visits to the site more efficient.
Cookies may store a variety of information including pages that you visit, and information about the location you are viewing and your own personal page viewing preferences. Our cookies don’t collect personal information and we do not sell this information or use the information for advertising.
The use of cookies is a common practice adopted by most major sites to better serve their clients. You can refuse or delete cookies. You can disable cookies from your computer system by following the instructions on your browser or at www.allaboutcookies.org. Most browsers and mobile devices offer their own settings to manage cookies. However, if you refuse a cookie SiteSage will not run as it is a web application and requires user information in order to display relevant content.
Some Internet browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference (the “DNT Signal”) to the websites you visit indicating that you do not wish to be tracked. Because there is not yet a common understanding of how to interpret DNT Signals, nor a common definition of “tracking,” we do not currently respond to DNT Signals on the Site.
Security
The security of your Personal Information is important to us, and we maintain physical, electronic, and procedural safeguards to protect the confidentiality and security of information transmitted to us. Remember however that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
We urge you to keep any password that you establish with us in a safe place and not to divulge it to anyone. Also remember to log off your account and close your browser window when you have finished your visit. This is to ensure that others cannot access your account, especially if you are sharing a computer with someone else or are using a computer in a public place.
Your Privacy Rights
Your Rights and Choices: You may be able to request to exercise the following rights in relation to your Personal Information:

- The business or commercial purposes for collecting or selling the Personal
- The Right to Request Deletion of Personal Information we have collected from
Note however that this right is limited by a number of exceptions. Fundamentally, if Powerhouse Dynamics has a permissible need to retain Personal Information, it is not under an obligation to delete such information, even when requested. Generally, we retain Personal Information so we may complete the transaction for which the Personal Information was collected, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between us and you; detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity; debug to identify and repair errors that impair existing intended functionality of our online properties; enable solely internal uses that are reasonably aligned with your expectations based on your relationship with Powerhouse Dynamics; comply with a legal obligation; or otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information. As such, we generally do not accept requests to delete Personal Information.
Right to Opt-Out: We collect, process, and share your information for purposes described in this Privacy Policy, which include the use of personal information for PHD’s operational purposes, or other notified purposes, provided that the use of personal information is reasonably necessary and proportionate to achieve the operational purpose for which the personal information was collected. We do not “sell” Personal Information, meaning, we do not exchange or disclose your Personal Information for monetary or other value to PHD. As such, we do not offer a
“Right to Opt-Out” for the sale of Personal Information to third parties.
You also have the right to be free of discrimination for exercising these rights. However, please note that if the exercise of these rights limits our ability to process Personal Information, for example, if you submit a deletion request, we may no longer be able to provide you our products and services or engage with you in the same manner.
To submit your Consumer Rights Requests: You may submit a request to exercise your Consumer Rights through one of the mechanisms described below. We will need to verify your identity before processing your request, which may require us to request additional Personal Information from you or require you to log into your account, if you have one. In certain circumstances, we may decline or limit your request, particularly where we are unable to verify your identity or locate your information in our systems, or as permitted by law.

Finally, you may also submit a verifiable consumer request through an authorized agent. To do so please be prepared for your agent to provide a signed permission to do so, to verify their own identity with us, and to directly confirm with us that you provided the agent permission to submit the request.
To the extent you have an established business relationship with us, you may have additional rights with regard to the disclosure of certain types of Personal Information to third parties for their direct marketing purposes. To opt-out of having your Personal Information disclosed to third parties for their direct marketing purposes, please submit a request using one of the consumer rights request methods designated herein.
